Faegre & Benson Represents Telluride, Colorado in Eminent Domain Case

Faegre & Benson LLP is representing the Town of Telluride in one of the largest land acquisition trials in Colorado history. The trial involves the acquisition of a 570-acre parcel of land commonly known as the Valley Floor. Telluride is seeking to acquire the property through the power of eminent domain from its owner San Miguel Valley Corporation. The property will be acquired for public open space, park land and recreational uses.

The Valley Floor trial will begin on February 5th, 2007 in Delta, Colorado and is scheduled to last three weeks. During the trial, a jury will be presented with land-valuation evidence that will assist it in determining the final acquisition price.

Land appraisals by both sides have estimated the value of the land to be between $26 and $50 million. The town intends to pay for the land through the use of public funds and private fundraising efforts.
