A former U.S. lead smelting company achieved a partial victory in ongoing toxic tort litigation when the U.S. District Court for the Northern District of Indiana granted, in part, its motion to dismiss regarding nuisance and trespass. Faegre Drinker is serving as primary counsel for the company in a series of federal and state lawsuits brought by homeowners and evacuated public housing tenants who allege property damage and stress from historic operations related to the East Chicago Lead Contamination Superfund Site.
