Kinder Morgan Liquids Terminals Favorably Settles State and Private Environmental Lawsuits

Kinder Morgan Liquids Terminal favorably settled twin lawsuits arising out of contamination at a terminal in Paulsboro, New Jersey. The New Jersey Department of Environmental Protection (NJDEP) brought a lawsuit seeking remediation and recovery of $81 million in natural resource damages. The second lawsuit was a private party action that concerned allocation of responsibility for past remediation costs associated with environmental conditions at the terminal. Our firm represented the energy infrastructure company in the actions and settlement negotiations and advised Kinder Morgan on its agreement with the State of New Jersey to implement one aspect of the site remedy.
