Overview

Emily Weissenberger is an accomplished trial attorney, focusing on defending clients against product liability, mass tort, environmental, and complex litigation claims in the life sciences, pharmaceutical, medical device and consumer products fields.

Product Liability Litigation

Emily has extensive experience handling product liability cases from individual claims to large scale mass torts. She has served as defendants’ liaison counsel for large pharmaceutical and medical device litigations, including the California Ovarian Talc litigation, where she handled all aspects of the coordinated proceeding, case strategy and management of more than 700 cases.

She has counseled clients in Proposition 65 matters, including settlement negotiations for both retailers and suppliers of dietary supplements, food, beverages and commercial products. Emily defended a dietary supplement case through trial, winning a full defense verdict and the largest cost recovery for a Proposition 65 defendant in the history of the California statute’s litigation.

Commercial Litigation

Emily has represented national retailers and pharmaceutical suppliers in consumer fraud class actions. She has also worked on these matters in a national counsel defending these claims. Emily has tried cases to verdict in state and federal courts, and been involved in all phases of litigation. She also has obtained success for her clients through motions to dismiss, summary judgments and favorable settlements.

Personal Interests

Emily is an endurance athlete and has competed in a variety of triathlon distance courses from sprints to Half Ironman. Her competitive experience, energy and commitment translates to dedication to her clients, as well as Emily’s ability to overcome obstacles, and prevail in setbacks her clients may face.

Outside the office, Emily also enjoys spending time outdoors with her family.
