Overview
Alice Morical is a go-to trial court litigator who is skilled at effectively navigating complex and high-stakes litigation. She represents clients across the country in commercial litigation, class actions, mass torts, and product liability disputes.
Alice enjoys learning about her clients’ businesses and priorities and offering practical advice and creative solutions to help them navigate the legal system to achieve their objectives. She finds that developing an effective strategy, preparing thoroughly and maintaining an objective perspective are key to maximizing her clients’ chances for success.
She is an elected member of the American Law Institute, a senior fellow of the Litigation Counsel of America, a 2024 IBJ Woman of Influence and a distinguished life fellow of the Indianapolis Bar Foundation. Alice regularly presents on litigation topics at major legal conferences as well as directly for clients and in-house audiences. Business Litigation
In federal and state courts, Alice represents companies and individuals in disputes relating to breach of contract claims, class actions, mergers and acquisitions, business torts, securities fraud, and defamation claims. In addition to experience with jury and bench trials, Alice has also represented clients in arbitrations and on appeal in federal and state appellate courts. Alice’s representative experience includes:
- Obtained a favorable jury verdict for a publicly traded company sued for breach of contract and fraud in connection with the sale of a subsidiary.
- Represented a publicly traded company in a successful Seventh Circuit appeal to overturn an adverse jury verdict in a defamation case involving a matter of public concern.
- Represented a municipality in successfully overturning a trial court summary judgment order and then obtaining summary judgment for the municipality.
- Represents a client in a contract and business tort dispute involving a software licensing contract pending in federal court.
- Represents a large university in Title IX and state law negligence cases.
- Defended the managing members of an LLC in a dispute with current and former minority members against claims including freeze-out, breach of the operating agreement, and breach of fiduciary duty.
- Represented founders and their newly formed company sued for unfair competition after their departure from a national firm.
- Represented a doctor in a high-profile Medical Licensing Board proceeding and successfully defeated an attempt to restrict the doctor’s medical license.
Product Liability & Torts
Alice also represents clients in product liability and substantial tort actions including in multidistrict, class action and coordinated proceedings. She vigorously defends her clients at all stages of litigation including depositions, discovery and court hearings. Alice is particularly experienced in product liability matters involving the technology industry and has taken depositions as part of the offensive discovery team in a high-profile matter involving a social media platform. She has also served on the offensive discovery team in a mass tort matter involving a national sports league.
Professional & Community Service
Alice believes that nonprofit service and pro bono work are important to the health and vitality of both the legal profession and her community of Indianapolis. She has served the Indianapolis Bar Association in several roles and as a director for various organizations, including Elements Financial, a federally charted credit union originally formed to serve employees of Eli Lilly. Alice also enjoys mentoring early-career attorneys to help them develop into strong advocates for our clients.
Personal Interests
Alice and her husband are grateful they share interests with their adult children, who all love traveling, reading, eating out and just spending time together. She travels frequently to the East and West Coasts to visit them. Alice also enjoys running half marathons, hiking in Brown County and in any travel destination, cooking New York Times recipes, getting together with friends, and attending cultural events.
