Overview

Peter Meyer litigates matters nationwide, primarily assisting companies with global strategy and aggressive defense as a member of the firm’s nationally ranked products liability and mass torts practice.

Peter has achieved successful results for the world’s leading medical device companies while serving as national and co-lead defense counsel in MDLs and single-plaintiff cases, spearheading efforts in every facet of the litigation, including:

  • Negotiating and implementing case management orders to build successful foundations and resolutions of MDLs.
  • Leading and coordinating large e-discovery vendors and teams.
  • Building the company case through strategic defense of company and sales representative depositions.
  • Identifying leading scientific and medical experts and transforming them into powerful and confident witness advocates.
  • Defeating Plaintiffs’ expert witnesses through depositions and Daubert briefing.
  • Achieving multiple wins in bellwether cases, both through full summary judgment rulings on the merits and trial victories.
  • Developing and leading strategic settlement plans to stifle attempts to build mass torts and to limit client expense and exposure.
  • Negotiating and implementing settlement programs to resolve mass torts at their conclusion and limit “tail” exposure, including through obtaining Lone Pine orders that discourage further filings of unmeritorious cases.
  • Successfully briefing and arguing appeals to preserve favorable trial court outcomes.
  • Advising medical device companies on quality systems, labeling and risk management to lower liability exposure before it forms.

Examples of representative past experience include:

  • In re: Zimmer NexGen Knee MDL, MDL No. 2272 (numerous bellwether victories through trial, summary judgment, and voluntary dismissals)
  • In re Zimmer M/L Taper and M/L Taper with Kinectiv Hip Prosthesis MDL, MDL No. 2859 (Daubert and summary judgment victory in initial bellwether)
  • Webb v. Zimmer, Inc., et al. (full defense victory via summary judgment)
  • Cassatt v. Zimmer, Inc., et al. (full defense victory via summary judgment, successful defense on appeal)
