Overview

Kevin Major counsels clients on negotiating and drafting complex agreements for major construction and real estate projects. He represents owners as well as contractors on both public and private projects. Kevin’s experience and skill help him to quickly identify the key issues during negotiations and find solutions that are beneficial to clients.

Construction & Real Estate Transactions

Kevin is experienced in leading the drafting and negotiation of project agreements valued from multimillions to multibillions, including design-build (DB), design-build-finance-operate-maintain (DBFOM), design-build-own-operate-maintain (DBOOM), engineer-procure-construct (EPC), operation and maintenance (O&M), performance contracting (PC), and energy-as-a-service (ESA) agreements.

Public-Private Partnerships

One focus of Kevin’s practice is public private partnerships (P3), particularly for social and horizontal infrastructure assets. For this approach to project delivery, clients benefit from Kevin’s substantial procurement and financing experience.

Zoning & Land Use

Kevin leads zoning and land-use approval processes for clients, including energy and industrial companies, in Illinois and Colorado.

Representative Experience

  • Northern Indiana Commuter Transportation District in its procurement efforts for a $554 million expansion of existing rail lines using the DB project delivery method.
  • A building technology and equipment provider in the drafting and negotiations of two ESA agreements and their amendments, totaling a combined value of approximately $450 million.
  • For an electricity and natural gas provider, helped lead the zoning and land-use approval process across six jurisdictions for an approximately $1.7 billion transmission line project.
