Jane Dall Wilson Speaks With Law360 About Trans Athlete Supreme Court Ruling

Litigation partner Jane Dall Wilson spoke with Law360 about the U.S. Supreme Court's decision permitting states to ban transgender athletes from girls' sports.

The court said the question of a state's ability to permit transgender athletes to compete on women's and girls' sports teams was an issue for litigation in lower courts. But Wilson noted that the court's decision was premised upon concerns about competition safety for cisgender female athletes.

"While those concerns are characteristic of a state's discretion to regulate health, safety, morals, and general welfare, challenges from cisgender athletes to trans-inclusive policies will likely rely on this decision for support even though the court expressly reserved the question of whether states may permit transgender athletes to participate and noted that question is the subject of ongoing litigation," Wilson told Law360.
