Matthew Fontana Quoted by SHRM on Independent Contractor Rule

In “Prepare for the Effective Date of the Independent Contractor Rule,” labor and employment partner Matthew Fontana spoke to the Society for Human Resource Management (SHRM) about the March 11, 2024, effective date of the U.S. Department of Labor’s independent contractor rule.

Fontana said employers should be aware of the amount of control they claim over the work the independent contractor is performing, including reserved control. Regarding internal audits, he also noted that employers should explain that there has been a change in the law and, as a result, the employee’s status was reviewed and needs to change.
