FTC Proposes Sweeping, Nationwide Regulations for Automatic Renewals

Business litigation counsel Matthew Adler, partner Michael Daly and associate Meaghan Geatens coauthored an article for the American Bar Association (ABA) titled “FTC Proposes Sweeping, Nationwide Regulations for Automatic Renewals,” which discusses the Federal Trade Commission’s (FTC) proposed amendments to the Negative Option Rule.

Adler, Daly and Geatens provide an overview of the Negative Opinion Rule, which would regulate continuous contracts, automatically renewing agreements, and free or discounted trials in addition to prenotification plans. The authors also discuss disclosures, consent, renewal reminders, cancellation, misrepresentations and enforcement.
