Tips and Tricks to Evaluate and Prepare Your Case for Snap Removal

Product liability and mass torts partners Molly Flynn and Kip McDonald and associate Hannah Anderson coauthored an article for the American Bar Association’s Corporate Counsel Committee on best practices for corporate counsel to evaluate and effectuate a snap removal.

The authors note that deciding whether to snap remove a case should be a quick decision and does not need to be a stressful process. They also outline four key steps, including analyzing the removability of a state court case, researching circuit removal precedent and relevant local rules, assembling the removal papers, and filing the snap removal.

Overall, the authors highlight that snap removal success depends both on familiarity with the removal rules and processes and on the ability to plan ahead.
