Peter Baldwin Quoted in The Washington Post about Senator Elizabeth Warren’s New Proposal to Expand Criminal Liability for Executives

Partner Peter Baldwin was quoted in an article in The Washington Post titled “The problem with Elizabeth Warren’s plan to jail more CEOs.” The article examines legislation recently introduced by Senator Elizabeth Warren that proposes a broad expansion of potential criminal liability for corporate executives.

In the article, Pete said, “I understand the gut reaction of most people in the United States who say we want to hold these banks and executives responsible for the problems that occurred in our economy. But do we want to change the standards of our criminal law to do that?” He further articulated that, Senator Warren’s proposed legislation, which requests a negligence standard for criminal liability for corporate executives, alters the traditional requirement in criminal cases that the government prove a defendant’s participation in or knowledge of criminal activity.
