Justices Clarify Limitations Period for Toxic Tort Birth Defect Claims

San Francisco partner Alan Lazarus authored a Los Angeles Daily Journal and San Francisco Daily Journal article titled “Justices Clarify Limitations Period for Toxic Tort Birth Defect Claims.” The article discusses the recent California Supreme Court decision in Lopez v. Sony Electronics, Inc., which decided that the period to file a suit for birth defects attributed to exposure to a toxic substance does not begin to run until the plaintiff turns 18 -- drastically extending the time before the suit needs to be filed. Alan also had filed an amicus brief on behalf of the Product Liability Advisory Council in the case, supporting the defense position.
