E-Verify has released new and revised E-Verify Memorandums of Understanding (MOUs). The MOUs are now tailored to specific users and access methods. They have been revised and reorganized with the goal of making them easier to read and understand. The new and revised MOUs also include several updated provisions, such as enhanced privacy protections and instructions for reporting privacy and security breaches.
Important Points to Know:
- The E-Verify enrollment process has not changed. New users will review and execute the new or revised version of the MOU that applies to their access method during enrollment. The effective date of the MOU for new users was December 8, 2013.
- Existing users will not need to execute a new MOU, but are bound by any and all changes to the E-Verify program, including the new or revised MOU that applies to their access method. The effective date of the MOU for existing users is January 8, 2014.
E-Verify is a free, web-based service offered by the Department of Homeland Security (DHS), in partnership with the Social Security Administration (SSA), that allows employers to electronically verify the employment eligibility of new employees by checking the information provided by the employee on the Form I-9 against the DHS and SSA databases. The E-Verify MOU sets forth the terms and conditions which the E-Verify user must follow while participating in E-Verify.
The three existing MOUs have been revised for E-Verify Brower Users:
- E-Verify Employer Memorandum of Understanding
- E-Verify Employer Agents Memorandum of Understanding
- Employers using an E-Verify Employer Agent Memorandum of Understanding
There are three new MOUs created for Web Services Users:
- Web Services Employers Memorandum of Understanding
- Web Services E-Verify Employer Agents Memorandum of Understanding
- Employers using a Web Services E-Verify Employer Agent Memorandum of Understanding
The new and revised MOUs are printed with a revision date of June 1, 2013. The E-Verify Memorandum of Understanding for State Workforce Agencies (SWA) has not been revised.
Current E-Verify users should review and become familiar with the new or revised MOU that applies to their access method.
