The U.S. Food and Drug Administration is considering imposing tracking requirements on not just the production of high-risk foods, as is already mandated in the Food Safety Modernization Act, but extending the requirements to all foods. Sarah Brew, partner at Faegre Baker Daniels, thinks the expanded regulations will garner support from many in the food industry. "A lot of companies are doing this already, and to a certain extent, [they're thinking] if we're doing this, we want everyone else to do it, too," Brew said to Law360.
However, she added that the industry's support could wane if the agency neglects to provide specifics on how to meet the new standards. Without clear guidelines, companies will want to continue the practices they've already implemented. "If you already have a system in place and you feel it's workable, and FDA comes in and says you have to change the system, you might feel, 'We have something that's already working. We shouldn't have to tinker with it,'" Brew said.
