Overview

Philadelphia partner David Abernethy presented at a Philadelphia Bar Institute program on “Directors’ and Officers’ Liability Insurance” in Philadelphia, PA on May 20, 2010.  As directors and officers face increasing exposure not only in civil lawsuits, but also in regulatory proceedings, government investigations and even criminal prosecutions, it is imperative that lawyers advising businesses, boards of directors and individual directors be conversant with directors and officers’ liability insurance, the unique aspects of that insurance relating to notice, coverage and exclusions, and the key differences between directors' and officers' coverage and other forms of liability insurance.  David, who concentrates his practice on commercial litigation, and his fellow panelists discussed directors and officers’ liability insurance, what it covers, how policies are negotiated, how notice is given, and how to manage and resolve coverage disputes, in or out of litigation, in a prompt and cost effective manner.
