State attorneys general have become aggressive regulators on the national stage. Whether bringing litigation in state courts or collaborating with other states on large-scale multistate investigations, the country’s AGs have taken aim at private sector conduct like never before — including for companies operating in life science industries. For example, State AGs have increasingly turned to expansive readings of state consumer protection laws, more aggressive use of state false claims act statutes, and private contingency fee counsel to litigate high-stakes matters. The impact of the COVID-19 pandemic on states and their residents — including impacts on state budgets — has accelerated these trends.
