In the wake of several high-profile cyberthefts (and resulting lawsuits), cybersecurity has become a “front and center” issue under ERISA. Recently issued cybersecurity “best practices” guidance from the Department of Labor (DOL) underscores the fact that plan sponsors and fiduciaries should make cybersecurity a priority. But cybersecurity is a dynamic and constantly evolving issue, and in the absence of formal rules or requirements under ERISA, what practical steps should plan sponsors and fiduciaries take? Can the DOL take action against plan sponsors and fiduciaries? How can plan sponsors help protect plan participants from cybercriminals, and mitigate potential fiduciary liability related to cybersecurity?
