Partners Laura Phillips and Mark Taticchi are presenting “The Upcoming Supreme Court Case Facebook, Inc. v. Duguid et al. and Key Legal Issues Under the TCPA,” a CLE of the Federal Communications Bar Association (FCBA) on Thursday, November 19, 2020, from 3:00 to 5:15 p.m., held virtually via the Zoom platform.

The U.S. Supreme Court is set to hear oral arguments in Facebook, Inc. v. Duguid et al. on December 8 and is poised to answer a longstanding Telephone Consumer Protection Act (TCPA) question: what exactly is an Automatic Telephone Dialing System (ATDS)?

This CLE will first provide an update on where things stand on key TCPA legal issues, including FCC and court developments on ATDS, reassigned numbers, consent revocation and more. And after a short overview of Facebook, Inc. v. Duguid et al., there will be mock oral arguments for the Facebook case. We will then debrief on the potential implications of the case’s outcome.
