Philadelphia partner Mike Daly will speak at the Strafford webinar titled “Alternative Strategies in Putative Class Actions After Campbell-Ewald Co. v. Gomez” on July 18, 2019.

 

Panelists will discuss the Supreme Court’s ruling in Campbell-Ewald Co. v. Gomez, in which the U.S. Supreme Court narrowly held that an offer of judgment under Rule 68 does not moot the claims of a would-be class representative. The majority addressed the narrow question presented and did not answer whether the result would have been different if the defendant had provided rather than merely offered complete relief. Since that decision, class action defendants have also tried several procedural and extra-procedural mechanisms for providing complete relief to named plaintiffs. The panel will also cover other methods that defendants can use to combat putative class actions.
