Please join us at the next gathering of the IFA’s Franchise Business Network-Minneapolis/St. Paul hosted by Faegre Baker Daniels.
Since the NLRB’s ruling in Browning-Ferris changed the standard for determining joint-employer status, franchisors are anxiously seeking ways to address the business and legal implications. In addition to the NLRB, other regulatory agencies like the Department of Labor also are looking for ways to hold a franchisor responsible for what occurs at a franchisee’s business. These recent regulatory developments are coupled with an increase in vicarious liability lawsuits where the claims focus on the nature of franchisor controls over the franchisee in an attempt to hold the franchisor responsible for the acts of the franchisee.
