Litigation partner Josh Mahoney has been named to Bloomberg Law’s 2026 “They’ve Got Next: The 40 Under 40” in the antitrust category, which recognizes lawyers under the age of 40 who are making significant impacts in their practices and the legal profession. This prestigious list is selected annually by Bloomberg Law's editorial team, which considers attorneys across the country and all areas of the law.
Josh was recognized for his work as co-lead counsel for Surmodics in the first merger challenge brought by the Federal Trade Commission during the second Trump administration. Weeks before trial, after an intense discovery period, Josh successfully argued a motion to compel, obtaining critical evidence of a nonparty device manufacturer’s substantial in-house coatings capabilities that undermined the FTC’s narrow market definition. At trial, he prepared and presented Surmodics’s first witness, whose testimony showed that Surmodics’s revenues were driven largely by long-term supply agreements won years earlier and the commercial success of customers’ devices — not by the competitive dynamics alleged by the FTC.
When asked how he defines success, Josh explained that he measures it by whether clients and colleagues return with new challenges and opportunities, noting that “the relationships forged in high-pressure litigation endure.” As for what he is most proud of, Josh pointed to how his Faegre Drinker case teams come together when the stakes are highest to deliver decisive results for clients, including in the Surmodics merger trial, where the team’s execution “sharpened from that intensity, not despite it.”
