Alicia Hickok Quoted in The Legal Intelligencer
Philadelphia partner Alicia Hickok was quoted in the Legal Intelligencer article titled, “Justices to Eye Consolidation Question That’s Split Appeals Courts.” The article discusses the Pennsylvania Supreme Court’s decision to grant allocatur in Malanchuk v. Sivchuk. The Court granted allowance of appeal to determine whether the en banc panel was correct.
Alicia commented on the fact that there are contradictory decisions on the effects of consolidation from the intermediate appellate courts due to confusion arising from the language in Pennsylvania Rule of Civil Procedure 213. “The intermediate appellate courts have to be the same in applying the law,” she said. “[A rule] can’t say something different in Superior Court than in Commonwealth Court.”
