Our firm is currently defending Postmates in a number of individual arbitrations as well as seven C-suite Postmates executives who have separately been named as individual respondents in 100 separate demands for arbitration.
On February 14, 2020, 10,335 individuals filed demands for arbitration against Postmates in the American Arbitration Association (AAA). On May 1, 2020, 100 of those individual claimants amended their demands for arbitration against the company to include seven C-suite Postmates executives as individual respondents. These demands allege claims regarding employee misclassification and assert that the individual respondents, as officers and shareholders of the company, directed that the company misclassify the claimants.
Our firm has been retained to represent the individual respondents only and have filed answers on their behalf. All parties have submitted their strike and ranking lists for arbitrators, and the AAA is in the process of assigning arbitrators and holding initial management conferences. It is anticipated these matters will each go to arbitration in the summer of 2021.
