Overview

Jane Maschka solves big problems. A tenacious litigator who knows how to win, Jane navigates some of the most complex financial cases in the country. In the last several years, Jane has returned millions of dollars to corporate victims of financial fraud. She also regularly defends her clients from bet-the-company risks involving insolvency, bankruptcy, and receiverships. Jane is the go-to litigator any time a case involves claims of fraud, fraudulent transfer, alter ego or successor liability. A thought partner and strategist, Jane is one of the nation’s most effective advocates when it comes to protecting and collecting her clients’ money.

Jane is not just aggressive; she is a relentless advocate for her clients’ bottom line. In one case, Jane collected millions of dollars for her corporate client, obtained a civil arrest warrant and ultimately drove the adverse company into bankruptcy while still making sure that her client got paid. In another case, Jane won a dismissal with prejudice, and had sanctions placed against the plaintiffs by proving they destroyed documents to cover their fraud. In yet another, she achieved a complete defense verdict at trial in Delaware Bankruptcy Court on behalf of a client facing more than $150 million in claims asserted by a trustee. Finally, in one of the most prominent bankruptcies in the country, Jane led a trial team to the best kind of victory when the trustee ultimately paid on the courthouse steps rather than face Jane at trial.

Jane’s passion is in finding the solution to the toughest financial problems in the law. Many lawyers can tell a client what should happen in a given case. Jane’s gift is to see what will likely happen before it does and to help her client prepare for and make the best decisions in light of it.
