Rodney Hudson has a strong track record of successfully representing pharmaceutical, medical device and technology companies in complex litigation, including product liability, mass torts, consumer fraud, false advertising, class actions and commercial litigation. In more than two decades in private practice, Rodney has represented clients in eight federal multidistrict litigation proceedings and six state coordinated proceedings involving thousands of cases, including serving as lead, co-lead and liaison counsel. Working closely with clients, Rodney guides nationwide legal strategy and represents clients in federal, state, trial and appellate courts across the country.

Coordinated Proceedings, Mass Torts and Product Liability

Rodney represents clients in complex, coordinated proceedings, at trial and on appeal. He effectively manages nationwide legal strategy to ensure that clients' legal interests are protected.

Within the last several years, Rodney has served as a member of nine trial teams in pharmaceutical and medical device cases pending in multiple jurisdictions around the country, including California, Illinois, Louisiana, Mississippi and Pennsylvania.

Rodney has argued and secured numerous significant victories for clients through dispositive motions before trial, including dismissals of claims based on federal law preemption in a mass tort proceeding involving thousands of cases. Rodney also has prevailed on behalf of clients on numerous appeals in federal and state appellate courts. One of Rodney’s recent appellate successes broadly impacted the litigation docket in a coordinated proceeding, resulting in dismissals of significant claims and cases.  

Class Actions and Commercial Litigation

Rodney represents clients in consumer fraud and false advertising class actions. He has defeated class certification and obtained dismissals of claims brought on behalf of putative classes. Rodney also represents clients in commercial litigation involving alleged trade secret misappropriation, breach of contract, trade libel, antitrust violations and related business disputes.

Counseling and Risk Management

Rodney counsels clients on regulatory compliance, risk management, privacy, First Amendment and related matters. He recently succeeded in challenging unduly burdensome state regulation of business activities as preempted by federal law, allowing a global client to continue to do business in the state. Rodney also advises clients on liability exposure of target companies during merger and acquisition due diligence.

Privacy and Data Security

Rodney works with clients to develop effective approaches to comply with the global patchwork of privacy and data security laws and minimize liability exposure. He has managed data breaches involving thousands of individuals.
