Kyle Essley helps clients weed through thorny commercial, environmental and financial disputes. Kyle advocates for clients at trial and on appeal, appearing in numerous state and federal courts throughout the country. He also represents businesses at arbitrations and meditations. Unlike many litigators, Kyle has extensive experience on both plaintiff- and defense-side cases at both the trial and appellate levels, giving him nuanced insight into how best to craft winning arguments regardless of which side his client is on.

Food, Agribusiness, Environmental and Natural Resources Expertise

Kyle has a heightened understanding of the regulatory and consumer challenges impacting food and agricultural businesses, and he has a firm grip on environmental and natural resource concerns. Having studied agricultural economics at Kansas State University, Kyle combines keen theoretical insights with practical experience supporting clients involved in power generation and energy provision, renewable fuel production, and food production, processing and distribution.

Complex Fraud, Financial, Commercial and Labor Disputes

Kyle also has significant experience litigating cases involving fraud, misuse of corporate form and funds, breach of fiduciary duty, tortious interference, and other acts of wrongdoing by corporate directors, officers and managers. In addition, Kyle works regularly in cases concerning alleged violations of complex agreements, including indentures, merger agreements, stock purchase agreements and collective bargaining agreements.

Appellate Litigation

Having clerked on a federal appellate court and worked on numerous appeals in private practice, Kyle has honed the craft of drafting appellate briefs and appellate motions. He has represented clients nationwide in the U.S. Court of Appeals in cases involving constitutional issues, labor and employment disputes, and allegations of fraud, racketeering and conspiracy. Kyle also has argued in front of the U.S. Court of Appeals for the Eighth Circuit.

Previous Experience

Before joining the firm, Kyle was an associate at Latham & Watkins, where he drafted motions and briefs, prepared expert witnesses for direct and cross examination, and second-chaired California Energy Commission (CEC) proceedings. Kyle also worked on securities class actions arising from alleged fraudulent misrepresentations in disclosures made by publicly traded companies. Prior to that post, Kyle clerked for the Honorable Steven M. Colloton of the U.S. Court of Appeals for the Eighth Circuit.

Personal Interests

Kyle enjoys hiking, kayaking, traveling with his wife, Sarah, and playing with his dog, Mellie.
