Lessons From a Year in Crisis: Do’s and Don’ts of Crisis Management

Product liability & mass torts attorneys Mike Zogby and Kaitlyn Stone and Corporate Counsel, Commercial at Exelixis, Inc., Claudia Garcia coauthored an article for the IADC’s Defense Counsel Journal that outlines pragmatic “dos” and “don’ts” for organizations faced with business crises.

Throughout 2020 and 2021, the authors partnered with ten in-house counsel and forensics/public relations professionals to dissect, publish, and speak on issues related to effective crisis anticipation and resolution techniques, as well as on the intersection of crisis, cross-border disputes, and litigation. While shared around the two-year anniversary of many working remotely, the recommendations can be applied to any business or risk-management crisis and should be incorporated into regular practices and response processes.

Guidance the authors discuss include “Don’t Think Crisis Happens in a Vacuum,” “Don’t Fix it and Forget it,” “Do Anticipate & Avoid,” “Do Pick the Right Players” and more. Overall, the article highlights that when in crisis — even when everyone is in the same crisis — a company’s best emergency response strategies will be specific to the organization.
