Greg Abrams Discusses Ruling Regarding Employment-Related Biometric Information Privacy Act Claim

Class Action Reporter

Labor and employment and litigation partner Greg Abrams’ client alert, “EPL Policy Triggers Duty to Defend Employment-Related Biometric Information Privacy Act Claims,” was published in Class Action Reporter.

In the article, Abrams highlights that for the last several years, the plaintiff’s bar has been bombarding companies doing business in Illinois with class action claims under the Illinois Biometric Information Privacy Act (BIPA), 740 ILCS 14/1 et seq., and how this spate of BIPA class action lawsuits has spawned derivative disputes over the scope of insurance coverage for such claims.

Abrams outlines a recent case where an Illinois federal court concluded that an insurer has a duty to defend such claims under its employment practices liability (EPL) policy.
