InsideHealthPolicy reported that on Oct. 8, the Centers for Medicare & Medicaid Services (CMS) released guidance reminding Medicare Advantage (MA) plans to take responsibility for third-party marketing actions. In “Memo Signals Biden Admin Will Keep Close Eye On MA Marketing Actions,” Faegre Drinker Consulting Principal Mike Adelberg commented on the impact of this guidance.
According to the publication, the guidance stated that MA organizations are responsible for ensuring that marketing materials used by third-party groups are submitted to the CMS before they’re used and that the marketing is not misleading any current or prospective enrollees. Further, the CMS outlined best practices for MA marketing and said that it is working with other federal agencies to investigate whether certain advertising content is compliant.
“It was widely speculated that guidance like this was coming. And it should be assumed that the Biden administration will look at marketing again,” noted Adelberg.
