The U.S. District Court for the Southern District of Indiana affirmed a decision of the U.S. Bankruptcy Court for the Southern District of Indiana in favor of the pro bono client.
The court held that an ex-wife could discharge obligations arising from her receipt of alleged child support overpayments. The case involved the proper legal standard for determining the dischargeability of a debt under 11 U.S.C. § 523(a)(2)(A) and interesting questions regarding legal emancipation under Indiana law.
