Division21 Recovers Damages in Breach of Agreement Lawsuit

Our firm represented Division21 in a lawsuit against Best Buy Company to recover damages for breach of a software-license agreement that contained an automatic-renewal provision that was subject to cancellation in writing by either party. Best Buy defended on the ground that the parties mutually agreed not to continue with the contract, even though there was no written notice of cancellation. Best Buy also defended on the ground it did not use the software after the first year of the parties' contract, thus indicating that it intended not to continue with the contract. After a week-long trial, the jury returned a verdict in favor of Division21 and awarded all damages that Division21 requested.
