FICO Wins Motion in Fireman's Fund Contract Dispute

Fireman's Fund Insurance Company alleged that FICO breached a professional services contract relating to workers compensation medical bill review charges, discounts, payments and reimbursements. Under the contract, FICO was to review bills for medical services provided pursuant to workers compensation laws and policies. Fireman's Fund alleged that FICO failed to maximize savings under the non-uniform workers compensation laws of 48 states. Fireman's Fund sought damages in excess of $30 million in the United States District Court for the Central District of California. Faegre Baker Daniels defended FICO against the claims, aggressively pursued fact and expert depositions across the country, crafted a trial and pre-trial motion strategy to minimize any alleged damages, and coordinated with the client to manage the ongoing services it was providing during the litigation. On the eve of trial, FICO won motion in limine to exclude all evidence supporting the bulk of Fireman's Fund's alleged damages. The case settled shortly thereafter.
