Overview

Kevin Toner is a trial lawyer who protects clients’ interests during complex civil litigation. Kevin litigates insurance, toxic torts, environmental, LLC control fights, and other disputes in courts, arbitrations and administrative proceedings.

Business Litigation

Kevin has tried and arbitrated business disputes in Indiana, Michigan, Illinois, Ohio, California, Connecticut and London, and he has appeared and litigated on behalf of clients in many other forums. For 35 years, Kevin has represented corporate clients and nonprofits. He has successfully resolved hundreds of disputes for defendants and achieved large recoveries for many plaintiffs. These cases provided Kevin with deep knowledge of insurance underwriting and claims, manufacturing processes, environmental remediations, computer systems technology, and the pharmaceutical, health and hospital industries. Kevin has also represented debtors, trustees and creditors in bankruptcy court, including litigating on behalf of the bankruptcy trustee to resolve all claims arising from a multibillion-dollar check-kiting scheme in the cattle industry.

Insurance Litigation and Counseling

Kevin has litigated and arbitrated the full spectrum insurance disputes among insurers, policyholders, agents, third-party representatives and regulators. His engagements have included domestic claim, international arbitrations and overseas property claims. He has experience with property and casualty, management liability, fiduciary liability, employers liability, cyber insurance, kidnap and ransom, crime, life, disability, and other coverages. Kevin has also performed and supervised audit teams for coverage assessments.

Regulatory & Investigations

Kevin represents clients in administrative proceedings in Indiana. He has conducted and managed internal corporate investigations involving regulatory compliance and sales practices, employee theft, trade secrets, and other sensitive matters. He also counsels clients and speaks to industry groups about their document and electronic information retention practices.
