Rachel Gartner* supports clients as they navigate the complexities of the FDA regulatory landscape, helping them bring new products, concepts and technologies to the marketplace. She has extensive experience providing strategic advice to businesses, including startups and major corporations, on FDA-regulated products, advertising and intellectual property matters. Rachel collaborates with companies whose products are regulated by the FDA to evaluate ingredients and product formulations and assess risk based on FDA policy.

As clients launch new food, beverage, supplement, cosmetic and medical device products Rachel assists with product classification, counsels on feasibility for market entry and advises on best practices for advertising and marketing such products in a legally compliant fashion on various media formats, including social media and traditional advertising. With knowledge and perspective on the entire product life cycle, Rachel provides valuable insight to her clients, focusing on understanding the client’s risk tolerance, objectives and goals to provide a practical approach to legal challenges.

When product complaints and challenges arise, Rachel represents clients in responding to agency enforcement actions, competitor challenges, and assists with litigation related to the Federal Food, Drug and Cosmetic Act.

Rachel offers experienced thought leadership on marketing and advertising regulations for food and healthcare companies. When companies take their products to market, she helps them navigate Federal Trade Commission (FTC) standards for substantiating marketing claims as well as requirements from the National Advertising Division of the Better Business Bureau and state and local regulators. Rachel helps brands selling FDA-regulated products navigate the legal complexities of influencer and social media marketing.
