Brandee L. Caswell



Brandee Caswell leads the firm’s eminent domain and real estate litigation practice in Faegre Drinker offices across the country. Brandee leverages real estate experience and litigation prowess to resolve complex, high-value disputes involving eminent domain, land use, owners’ associations, special districts and property valuation.

Brandee partners with clients to achieve both creative and common-sense solutions to matters essential to their business objectives. She helps clients understand and efficiently navigate even the most obscure legal proceedings involving real estate while maintaining a focus on early resolution. Whether the dispute involves complex takings via eminent domain, real estate development and finance disputes in excess of $75 million, urban renewal projects for shopping centers, or energy corridor condemnation projects over 100 miles long, Brandee recognizes it is the client’s objectives that define a successful outcome. She is an experienced and effective first-chair trial lawyer who has arbitrated and litigated cases in both state and federal court in numerous jurisdictions, including Colorado, California, Illinois, Florida, Minnesota Oklahoma, Texas, Wisconsin and Wyoming, and she has represented clients before judges, juries, arbitrators and commissioners. She nonetheless strives to achieve prompt and successful outcomes outside of the courtroom and without protracted litigation.

Brandee has achieved notable proficiency in the areas of eminent domain, the Colorado Common Interest Ownership Act (CCIOA), and special district/tax increment financing. Her decades-long eminent domain practice includes work on behalf of both landowners and condemning authorities in all types of condemnation proceedings, including highway expansions, utility projects and mixed-use/retail redevelopment projects. She continues to be recognized by Best Lawyers and Super Lawyers as an authority in the field of eminent domain and is a frequent lecturer on eminent domain topics locally and nationally for the American Law Institute.
