Jason R. Brost



Jason Brost represents financial services companies in complex commercial disputes and defends consumer class actions. Jason also has represented a wide variety of businesses and individuals in commercial, securities, insurance coverage and employment litigation matters, and has responded to investigations by law enforcement and regulatory organizations, including numerous state insurance regulators, the U.S. Department of Justice (DOJ), the U.S. Securities and Exchange Commission (SEC), and the Financial Industry Regulatory Authority (FINRA).

Representative Matters

  • Defended life insurer against complaint alleging that annuities issued by insurer and purchased by plaintiff were unsuitable product and were misrepresented by the selling agent; obtained summary judgment on six of eight counts; obtained jury verdict regarding contract claim and directed verdict on consumer fraud claim; successfully defended appeal
  • Defended multiple insurers against both class actions and individual lawsuits alleging that insurers’ cost of insurance adjustments on universal life insurance policies violated policies’ terms
  • Defended consumer products company against multiple consumer class actions alleging that claims on product labels were misleading
  • Defended issuer of lender-placed insurance against multiple consumer class actions alleging insurance was placed improperly and insurer paid inappropriate compensation to lenders
  • Defended insurer against class action lawsuit alleging elder financial abuse in connection with sales and surrenders of deferred annuity products
