Carita Austin



Using six years of experience as a National Labor Relations Board (NLRB) field attorney, Carita Austin collaborates with employers to help them comply with state and federal employment and labor laws, particularly those related to labor unions and organizing rights.

The NLRB process and regulations can be complicated and confusing. Carita understands the agency’s policies, practices and procedures and uses that understanding to advise clients who are facing labor law issues before the NLRB — where timelines move quickly compared to other agencies and court proceedings.

Carita is skilled in helping companies manage risk to avoid unfair labor practice charges. She represents employers in NLRB investigations and related litigation, union representation campaigns, collective bargaining, and arbitrations. She also conducts supervisory training in areas of employment and labor law.

NLRB Experience

  • Investigated charges against employers and unions across the spectrum of unfair labor practice (ULP) allegations, including complex allegations of misconduct in organizing campaigns, refusal to bargain in good faith and illegal union practices
  • Prosecuted ULP charges to resolution, including litigating ULPs at trial
  • Handled all aspects of representation petitions and elections, including under the NLRB’s new representation rules
  • Assisted with FOIA and immigration matters as they pertained to the NLRB
