Online Platform Scrutiny Continues as Congress Reviews Section 230

Faegre Drinker Consulting directors Matthew Rubin and Beena Patel coauthored an article for The National Association of Boards of Pharmacy titled “Online Platform Scrutiny Continues as Congress Reviews Section 230,” regarding the various government actions that have occurred in response to COVID-19-related online fraud.

The U.S. Food and Drug Administration and Federal Trade Commission have taken action against individuals and companies looking to profit off of the COVID-19 pandemic through alleged illegal activity related to fraudulent vaccines, treatments and cures. Rubin and Patel highlight some of these measures and the subsequent effects of this fraud, including increased scrutiny of the preeminent liability shield for online platforms known as Section 230 of the Communications Decency Act and the recent introduction of the Eliminating Abusive and Rampant Neglect of Interactive Technologies (EARN IT) and Platform Accountability and Consumer Transparency (PACT) Acts.
