Greg Abrams Comments on DOL’s Guidance on FFCRA’s Paid Parental Leave Requirements

On March 26 and 28, the U.S. Department of Labor (DOL) issued guidance about the Families First Coronavirus Response Act (FFCRA) and answered key questions about Emergency Family and Medical Leave Expansion Act (EFMLEA). In the article “DOL Issues Guidance on FFCRA’s Paid Parental Leave Requirements,” SHRM reported that while the guidance is useful, there are other questions that remain unanswered.

The industry publication turned to Labor & Employment partner Greg Abrams for insight into the recently issued guidance and asked the question “do employers need completely new Family and Medical Leave Act (FMLA) forms and FMLA policies due to EFMLEA leave?”

Abrams told SHRM that whether employers amend their forms and policies “is likely a case-by-case decision based on factors like the size and sophistication of the organization.”
