Litigation, Regulation Heating Up For E-Cig Manufacturers

Partner Kenneth A. Murphy and associate Christian E. Piccolo co-authored an article for Law360 exploring the challenges that manufacturers of electronic nicotine delivery system (ENDS) products face on both the regulatory and litigation fronts as they relate to an increase in youth ENDS use. In 2018, the U.S. Food and Drug Administration labeled e-cigarette use among teenagers an “epidemic.”

As a result of this growing concern, manufacturers of ENDS products are not only feeling the heat from the FDA, but also from the plaintiffs bar, as a number of class action complaints have been filed focusing on youth ENDS use.
