Cost-Shifting and Cost-Sharing Approaches Under the Proportionality Principles

Mike Zogby, Florham Park-based products liability partner and co-lead of the firm’s Pharma and Life Sciences industry group, and Sean Kennedy, products liability associate in Florham Park, published “Cost-Shifting and Cost-Sharing Approaches Under the Proportionality Principles” in the New Jersey Law Journal. The article examines the proportionality amendments to the Federal Rules of Civil Procedure, focusing on cost-shifting and cost-sharing opportunities, and discusses case law in which courts have applied cost-shifting or cost-sharing principles to commercial disputes. Mike and Sean also provide recommendations to balance the responsibilities associated with document collections and productions between the parties to a dispute.
