Building a Better Patent System

Bob Stoll, intellectual property partner in Washington, D.C., wrote an article in Law360, “Building a Better Patent System,” discussing proposed improvements to the patent system, which has not been significantly overhauled since the seminal America Invents Act in 2011.

Bob recognizes complications in the regulatory environment and states that “[w]ithout consensus, legislation is unlikely to move in this polarized Congress.” However, he emphasizes that the Patent and Trademark Appeals Board is discussing reforms, including the STRONGER Patents Act, which will address concerns from patent owners about AIA review procedures. He believes that the United States Patent and Trademark Office can implement many of these reforms under its existing regulatory authority and without legislation.
