GCD Wins Reversal of $20 Million Antitrust Verdict

On April 3, 2001, the Tenth Circuit U.S. Court of Appeals reversed a $20,641,548 judgment that had been entered against Gardner, Carton & Douglas’ (GCD) client Oklahoma Gas and Electric  Company (OG&E). In a complete victory, the Tenth Circuit has ordered the case to be dismissed in its entirety. The Tenth Circuit’s ruling was written by Judge Paul J. Kelly, Jr. and concurred in by Judge Mary Beck Briscoe and District Judge Carlos Murguia. On May 1, 2001 the Tenth Circuit unanimously denied Trigen’s petition for rehearing and suggestion for rehearing en banc. This case is reported at 244 F.3rd 1220.
