USPTO–World Intellectual Property Organization Summer Program on Intellectual Property

U.S. Rights of Publicity

Overview

Washington, D.C., partner, Gary Rinkerman spoke on U.S. rights of publicity at the USPTO - World Intellectual Property Organization's Summer Program on Intellectual Property on August 9. 

 

The presentation traced the rights of publicity from its inception to the present-day developments and disputes, e.g., advertising uses and use in film, television and video games.  (A particularly well-received exhibit was a 1934 Ford Motor Co. advertisement noting that the Ford V-8 Phaeton was John Dillinger's preferred getaway car.) 

 

Gary also discussed key oversights in copyright and trademark licenses -- transactions that should also include rights of publicity clauses were identified for the audience and placed in the context of past and current litigation.
