Outside Investigations: When to Recommend Them and How to Survive Them

Overview

Philadelphia partner Scott Coffina spoke at the NACUA (National Association of College and University Attorneys) Annual Meeting, on a panel titled “Outside Investigations: When to Recommend Them and How to Survive Them,” on Friday, June 21, in Philadelphia.

The panel discussed the factors colleges and universities should consider in deciding whether to engage outside counsel to conduct an internal investigation, to whom outside counsel should report while conducting an internal investigation, privilege issues and preparing reports of such investigations.  Scott advised the audience, which consisted mostly of inside counsel, that they ought to be very proactive in investigating concerns when they first arise, in order to deal with the problem quickly and effectively if necessary, and to be able to justify whatever actions they take, or don’t take, if the issue blows up publicly later.
