What is the Current Inequitable Conduct (IC) Standard? - How Does it Apply in Patent Prosecution?


Washington, D.C., partner Mercedes Meyer, gave a presentation on current standards pertaining to Inequitable Conduct in patent prosecution for the American Intellectual Property Law Association October 13, 2009. Mercedes, a partner in the firm’s Intellectual Property Practice Group, covered basic principles of Inequitable Conduct, significant case law in the area, the future for Inequitable Conduct and implications for prosecution. She then debated the pros and cons of doing away with inequitable conduct with John Johnson of Fish & Richardson, who presented his views from a litigation vantage point.
