The right of publicity has become an increasingly critical consideration for any practitioner dealing with the intersection of modern marketing and content development. Moreover, while rights of publicity are currently recognized in 35 states, controversies still simmer over the proper role and scope of this patchwork of laws, as tensions (and litigation) have often grown alongside new laws, platforms and licensing deals.
Although disagreements are common over questions of how best to deal with property rights in a person’s name, likeness, image and persona — even after their death — it is vital for clients and colleagues to understand different perspectives on what promises to be a complex and combative arena of intellectual property practice for the foreseeable future.
