What’s in a Name, Likeness and Image? The Prospect of a Federal Right of Publicity



The right of publicity has become an increasingly critical consideration for any practitioner dealing with the intersection of modern marketing and content development. Moreover, while rights of publicity are currently recognized in 35 states, controversies still simmer over the proper role and scope of this patchwork of laws, as tensions (and litigation) have often grown alongside new laws, platforms and licensing deals.

Although disagreements are common over questions of how best to deal with property rights in a person’s name, likeness, image and persona — even after their death — it is vital for clients and colleagues to understand different perspectives on what promises to be a complex and combative arena of intellectual property practice for the foreseeable future.

As part of its effort to promote a conversation among different perspectives in this often contentious space, Faegre Drinker is pleased to invite rights management agency CMG Worldwide to share its views on publicity rights and the prospect of a federal right of publicity statute. CMG has long been one of the nation’s highest profile advocates for strong publicity rights for celebrities and their estates, and this webinar will feature Founder and CEO Mark Roesler and In-house Counsel Garrett Hutchinson as they discuss their assessment of the future for the protection and use of these rights.
