Michael C. Zogby presented, and Kaitlyn E. Stone moderated, a webinar titled “A Roundtable on Corporate Risk Assessment and Strategic Crisis Management” as part of the Product Liability Advisory Council’s (PLAC) Virtual Fall Conference. They presented with Jeff Gates, associate general counsel at Porsche; Edward Glynn, principal of the Fraud Investigation & Dispute Services division at EY; Christine Anne Lozier, senior attorney of the Legal and Corporate Affairs division at Novo Nordisk; Ashley Minnifield, vice president of Edelman; Jonathan R. Murphy, senior legal counsel at Kawasaki Motors Corp., USA; and Ryan Stiles, senior assistant general counsel of the Litigation division at Polaris, Inc.
The roundtable discussion focused on risk assessment and crisis management strategies, including explanations of real-world tested tactics, weighing the pros and cons for each. Panelists analyzed approaches to avoiding legal crises, as well as strategies to managing crises with the help of in-house and outside counsel and vendors. Specific tools, including premortems and red teaming, were highlighted as ways to assess an organization’s plans, policies, systems, protocols and assumptions with the goal of improving the organization’s overall effectiveness and avoiding future crises. The panelists also addressed issues relative to product recalls, privacy and cybersecurity issues, with an eye to particular challenges arising in the all-remote work environment.
