American Bar Association's 2019 Midwinter Meeting of the Committee on Development of the Law Under the NLRA
Carita Austin led a presentation at the American Bar Association’s (ABA) 2019 Midwinter Meeting of the Committee on Development of the Law Under the NLRA. Entitled "Rules, Rules & More Rules: Memorandum GC 18-04 and Employer Work Rules in the Post-Boeing Company World," the presentation examined the National Labor Relations Board’s (NLRB) overruling of Lutheran Heritage Village-Livonia—which previously governed the NLRB’s standard for reviewing facially neutral workplace rules—and the subsequent creation of the Boeing standard. Carita also explored the benefits and limitations of the Boeing standard, which established a more predictable framework for interpreting the lawfulness of facially neutral rules in employee handbooks.
